EU to review aircraft passenger rights

In light of withering criticism, the European Union is proposing changes to the laws governing the rights of passengers travelling by plane. After the disruption that was caused by the Eyjafjallajokull volcano in Iceland last year, the EU regulations became the subject of increased attention, and a number of deficiencies were identified by carriers and passenger groups.

Airlines, which lost 2.2 billion as a result of airspace closures during the eruption, have argued that the Regulation on Air Passenger Rights was never designed to be used in situations like this, where airlines have no control over what’s happening.

According to the Vice President of the European Commission, the EU is ready to rewrite the rules in an effort to give more clarity regarding who takes responsibility if airspace has to be closed or extreme weather grounds flights. They are considering reducing the airlines’ liability.

The EU will also look at how compensation can be made to reflect the fares paid by passengers. After the ash cloud last year, budget airline Ryanair refused to pay compensation, arguing that they would end up paying customers more than what they paid for their tickets. Ryanair did eventually relent, but put a ceiling on the figure passengers could claim.

The European Commission appears to be receptive to the idea that the financial burden should be shared more evenly in circumstances like this. In future, airports that fail to clear snow from a runway, for instance, may be forced to pay towards compensation costs. Additionally, there is an expectation that greater emphasis will be placed on governments’ responsibility to intervene and make financial support available if something along the lines of the ash cloud comes along again. Consultations with stakeholders will proceed until the end of 2011, and a new proposal will be announced in 2012.

The earthquake and Japan in Tsunami captured the attention of the whole world as it tore across the country leaving people’s homes and businesses in ruins. After the tsunami subsided though and people thought it was time to rebuild the people of Fukushima were told they couldn’t return to their homes due to the nuclear risk from the nearby power plant. The people of Fukushima will have to be compensated for this but with the main cause being a natural disaster, who should compensate them and what should they receive?

The government decided to evacuate a 12 mile area despite the US Embassy recommending a 50 mile zone such is the danger presented by the nuclear plant. Every day the area is closed is another day they people will not be able to run their businesses or attend their jobs and this is creating financial losses that are huge for everyone from the evacuated area.

Whilst it is now the nuclear plant causing the problem they were not able to prepare for the earthquake and tsunami which caused the damage so should they be liable and if so how much should people be entitled too? It would be expected that residents should be reimbursed 100% for their losses but this will run into the hundreds of millions and is unrealistic for the company owning the nuclear plant to pay.

It has been suggested that other domestic utilities should help to pay the victims compensation but it is still a huge amount and Fukushima is not the only area of the country which needs rebuilding. The more realistic option is to pay the people exactly the amount they need to reach the position they were previously so they can continue as before.

The situation in Japan which caused the evacuation in Fukushima was an entirely natural disaster. Whilst the people which have been evacuated will need to be compensated, it will be down to the government to decide how much they receive. It is not necessarily just a question of how much but more so who will be responsible for paying the compensation?
